The following terms and conditions ("Terms of Use") govern your access to, and use of, this Web site located at www.thinklocal.co.uk  (the "Site") operated by Think Local Marketing Ltd and any of Think Local Marketing Ltd' services accessible through the Site.  The ThinkLocal.co.uk brand is a trading name of Think Local Marketing Ltd.  In the terms of Use we refer to Think Local Marketing Ltd as, Think Local, but not limited to.

BY ACCESSING, BROWSING, OR OTHERWISE USING THE SITE, YOU AGREE TO BE BOUND BY THESE TERMS AND ANY OF THE RELATED POLICIES OR GUIDELINES, INCLUDING ANY SUBSEQUENT CHANGES OR MODIFICATIONS TO THEM. IF YOU DO NOT AGREE TO THESE TERMS OF USE OR ANY CHANGES, DO NOT ACCESS OR OTHERWISE CONTINUE TO USE THIS SITE.

General

1. Think Local reserves the right to update and modify this Terms of Use at any time without giving you prior notice and it is your responsibility to make sure that you are familiar with the up to date Terms of Use.

2. New features that may be added to this web site shall be subject to these Terms of Use. Should you continue to use the web site after any such modifications have been made, this shall constitute your agreement to such modifications.

3. Think Local is not liable to you or any other person for anything in connection with any aspect of the Think Local web site or your use of it. In particular, Think Local is not liable to you or any other person on any basis for any loss or damage caused to you directly or indirectly by use of the Think Local web site.
 
4. You use Think Local services and the Think Local web site entirely at your risk. Think Local, its directors, employees, affiliates or other representatives
takes no responsibility for any system unavailability, or for any loss or damage that is incurred as a result of the Think Local web site or services being unavailable. Further, Think Local assumes no responsibility for the corruption of any data or information held by Think Local.

5. Think Local makes no warranties regarding (i) your ability to use the Service, (ii) your satisfaction with the Service, (iii) that the Service will be available at all times, uninterrupted, and error-free (iv) that bugs or errors in the Service will be corrected.

6. Think Local provides no warranty or guarantee that the Think Local web site or services will be error free or reliable.

7. Think Local provides no warranty or guarantee for the accuracy of information provided by Think Local or its clients.

8. Members of Think Local web site are solely responsible for the content of their listings.

9. The failure of Think Local to exercise any right provided for herein shall not be deemed a waiver of any right hereunder. The Terms of Use set forth the entire understanding between you and Think Local as to the Service and supercedes any prior agreements between you and Think Local (including, but not limited to, prior versions of the Terms of Use).

10. This Terms of Use constitutes the entire agreement, between the parties, relating to the subject matter of these Terms of Use.

11. Your use of the Service, including any content, information or functionality contained within it, is provided "as is" and "as available" with no representations or warranties of any kind, either expressed or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. You assume total responsibility and risk for your use of this Service.

12. Think Local, its affiliates and its sponsors are neither responsible nor liable for any direct, indirect, incidental, consequential, special, exemplary, punitive or other damages arising out of or relating in any way to your use of the Service. Your sole remedy for dissatisfaction with the Service is to stop using the Service.

13. If any provision of the Terms of Service is held invalid or otherwise unenforceable, the enforceability of the remaining provisions shall not be impaired thereby.


Membership Terms

1. You must provide your full legal name, a valid email address, and any other required information to complete the sign-up process.

2. You are responsible for maintaining the privacy and security of your account. Think Local will not be held liable for any damage or loss that may result from your failure to protect your login information, including your password.

3. You agree to keep your membership information, including email address, residential address, and telephone number, current at all times.

4. You may not use the service to store, host, or send unsolicited email (spam) or SMS messages.

5. You understand that the Service can be used for transmission of your Content, and that during processing, your Content, including listings, and personal messages, may be transferred unencrypted over the Internet.

6. You may not use the service to transmit any viruses, worms, or malicious content.


Modifications to the Service

1. Think Local reserves the right to modify, suspend, or discontinue the Service at any time for any reason with or without notice.


Payment and Publication


The Following Conditions apply to the acceptance of all advertisements for publication in any publications by  ThinkLocal.co.uk or/ and Think Local Marketing Ltd or any subsequent company controlled by these companies or its Directors  [ hereinafter called “The Publisher”] whose office address is Unit 8A, Welch Hill Mill, Arthur Street, Leigh WN7 4DJ.

 
1. The Publisher shall at its absolute discretion have the right to omit from, suspend or change the position of any advertisement accepted for insertion in any publication or website managed and published by it.

2. The Publisher shall at its absolute discretion have the right to make any alterations deemed by them to be reasonably necessary or desirable to an advertisement and may at any time require any artwork or copy to be amended by a customer to meet its approval.

3. The Publisher will not be responsible for any error in the insertion of any advertisement in any publication or for the omission of such advertisement or for any damage or loss consequential there from or for the damage or loss of any artwork, drawings or other materials supplied for the purpose of publishing an advertisement.

4. It is the responsibility of advertisers to check their advertisements for any error on its first insertion and indeed prior thereto and proofs will be required for those advertisers notifying the Publisher in writing that they require same on the strict understanding that proofs are intended to conform to the advertiser that their intentions have been carried out and for no other reason and that the proof will belong to and remain the property of the Publisher.

5. Payment terms are 7 days from invoice date.

6. The Publisher shall have the right to change advertisement rates at any time.

7. The Publisher shall not be bound by notice of stop orders, cancellations or transfers of advertisements booked for insertion  received less than 10 days before advertising deadlines. The Publisher reserves the right to charge in full for any advertisements cancelled less than 7 days before the deadline.

8. All advertising should be ‘legal, decent, honest and truthful’ in accordance with the Advertising Standards Authority and comply with the Code of Advertising Practice. It is an offence for any trader to advertise the buying and selling of goods unless they clearly state they are in business.

9. The placing of an order for the insertion of an advertisement either verbally or in writing will amount to an acceptance of the above conditions and payment terms as laid out on this form and any condition stipulated on any order form or elsewhere by an agency or an advertiser shall be void in so far as they are in conflict with them.

10. Series discounts are offered on the understanding that the agreed run of advertisements are fulfilled by the client. If for any reason the agreed series booking is not honoured the client will be charged the full advertisement rate at that time.

11. Outstanding account balances may incur an interest charge at the publishers discretion.


Cancellation and Termination

1. You alone are responsible for the proper cancellation of your account. You may cancel your account at any time by clicking on the Account link in the Service's navigation menu. The Account screen provides a simple link to cancel your account. Email or phone requests to cancel your account will not be deemed cancellation.

2. Your account and all of its Content will be deleted immediately upon your cancellation of the Service.

3. Think Local reserves the right to modify, suspend, or terminate your account at any time for any reason without notice. We also reserve the right to delete all Content associated with your account. Think Local may refuse service to anyone for any reason at any time.

4. Refunds of any kind or solely at the management’s discretion.


Copyright and Ownership

1. Think Local or its suppliers own the intellectual property rights to any and all protectable components of the Service, including but not limited to the name of the Service, artwork and end-user interface elements contained within the Service, many of the individual features, and the related documentation. You agree not to copy, modify, adapt, resell, duplicate, reproduce, distribute, reverse engineer, decompile, dissemble any aspect of the Service which Think Local or its suppliers own.

2. You agree not to resell, duplicate or publicly display any content from the Think Local web site without prior written permission from Think Local.

3. Think Local claims no intellectual property rights over the Content you upload or provide to the Service. However, by using the Service to upload Content, you agree that others may view and share your Content.

4. Think Local claims no responsibility over the listings on this website, Think Local cannot judge if listings are genuine and therefore claims no responsibly to the listing or its contents.

5. Think Local resurves the right to deniy request for personal information about its members.

6. Think Local Terms of Use,  and any matter relating to this Site shall be governed by English law and any dispute shall be resolved exclusively in the courts of England.

If you do not comply with any part of the Terms of Use, Think Local may, without notice or warning, remove your listing, issue you a warning or suspending or terminating your membership.  Any questions regarding the Terms of Service should be addressed to support at Think Local.
